Terms of Service

Plain language, on purpose. These terms cover the Polka app and the sync service behind it, made by Luke Evers (Llama Luke).
The service
Polka is a colour diary for iOS. The app works on your phone; an account and the sync service exist so your journal can follow you to a new device. Media — photographs and voice recordings — stays on your phone and is not part of the service's storage, as the privacy policy describes.
Your content is yours
Everything you put into Polka — colours, notes, photographs, recordings, pictures — belongs to you. By using sync, you give us permission to store and transmit the synced parts (colours, notes, settings) solely to provide the service back to you. That's the entire licence; we claim nothing else, and it ends when you delete your data.
Your account
- You need an account to use Polka, created with email and password or by signing in with Apple or Google.
- Keep your credentials to yourself; you're responsible for activity under your account.
- You can delete your account at any time from Settings. Deletion is immediate, complete, and irreversible — every synced row and your identity are destroyed.
- We may suspend or remove an account that abuses the service — for example, attempting to access another person's data or to disrupt the service itself.
Acceptable use
Use Polka as a diary. Don't attempt to break its security boundaries, probe other accounts' data, reverse-engineer the service to those ends, or use it to store unlawful content.
The honest caveats
- Polka is currently pre-release ("coming soon"), built and run by one person.
- The service is provided as is, without warranties of any kind, to the fullest extent the law allows.
- We are not liable for indirect or consequential damages; where liability cannot be excluded, it is limited to the amount you paid for the service (currently nothing).
- Back up what matters to you: Settings offers a full journal export precisely so your record never depends on any one phone or on us.
Changes
If these terms change, the new version will be posted at this address with a new effective date. Material changes to what the service stores or how deletion works would also be reflected in the app itself, in plain sight.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
